Florida laws pertaining to the Offenses of Robbery and Burglary carry extremely harsh penalties

Robbery vs. Burglary

West Palm Beach Robbery

Robbery is a crime of theft wherein the accused uses some type of force, violence or threat of violence against another person during the commission of the crime. Robbery is a felony that is punishable by up to 15 years in prison and up to 30 years if a weapon or firearm was used.

If a weapon is used, it is referred to as armed robbery, and depending on what transpires during the crime, the penalties differ:

  • Mandatory 10-year minimum imprisonment for weapon possession
  • Mandatory 20-year minimum imprisonment if the firearm was discharged
  • Up to 25 years to life if the victim suffered serious bodily injury

Convicted repeat or habitual offenders suffer more severe consequences.

West Palm Beach Burglary

Burglary is entering a home, business, building or vehicle for the purpose of committing a crime therein. Burglary can hold penalties ranging from five years to life in prison, depending on the severity of the crime. Burglary becomes a first degree felony when it is accompanied by an assault, battery, weapon possession or severe property damage. It is also possible to be convicted of burglary for simply trespassing.
