The possession of drug paraphernalia is a criminal offense that is prosecuted as a misdemeanor in Florida. Our West Palm Beach drug paraphernalia lawyers at our firm can provide you with the defense you need to fight these charges.
What Is Considered Drug Paraphernalia in Florida?
The state of Florida defines drug paraphernalia as any equipment, product, or material that is specifically designed for use in the manufacturing, storing, concealing, injecting, ingesting, inhaling, or otherwise introducing of a controlled substance into the human body. It can also be any equipment that is designed for use in growing, harvesting, processing, packaging, repackaging, storing, or containing marijuana. The paraphernalia may be found in the actual possession of the person charged or it may be found in the same location as controlled substances or marijuana.
Penalties for Drug Paraphernalia Possession
The penalties for drug paraphernalia possession are dependent on the type of paraphernalia and the amount of controlled substances found in the same location as the paraphernalia. For example, if the paraphernalia is a pipe or a bong and no controlled substances are found in the same location as the paraphernalia, the person charged with this offense may be guilty of a noncriminal infraction. However, if controlled substances are found in the same location as the paraphernalia, the person charged may be facing a misdemeanor of the second-degree and drug possession.
