What is Extortion?

Extortion is defined as the use of threats, coercion, or intimidation to get money, goods, or services. The willingness of the person giving the money, goods, or services must be directly because of the use of threats, coercion, or intimidation. Common forms of extortion include shakedowns, extraction, blackmail, public corruption, or ransom. Cyberextortion is a form of extortion, where a person electronically steals secrets from another and threatens to release them unless money, goods, or services are paid.

What is Bribery?

Bribery is defined as the offering, giving, receiving, or solicitation of anything of value in exchange for a favor from someone who works in government, politics, business, sports, or public service. Even the mere offering of anything of value is considered bribery, and the actual exchange does not need to take place in order for charges to be filed.

Under federal law, 18 U.S.C. Sec. 666, it is against the law to for any agent of a political organization to solicit or demand anything worth more than $5,000 with the intent of it being used as an influence or award. This applies to any local or state entity that receives federal money. In addition, the Foreign Corrupt Practices Act forbids bribes to foreign officials in order to win international contracts for businesses and can be charged with bribery for doing so.

Penalties for Extortion & Bribery

Under Florida law, conviction for bribery and extortion is a second degree felony offense. This comes with a prison sentence up to fifteen years, fifteen years of probation, and a fine up to $10,000. A federal conviction for bribery includes a fine up to three times the amount of the bribe in addition to up to fifteen years in federal prison. That person is also disqualified from holding any office of honor, trust, or profit for the United States. A federal conviction for extortion comes with a wide range of penalties, depending on who did the extorting and to whom. All convictions at the federal level for extortion come with serious fines and prison sentences.
