What Constitutes a “Cybercrime”?

The term “cybercrime” is a generic legal term that includes any criminal activity in which a computer or computer networks were used. You can find all the relevant laws in the Florida Statutes Chapter 815. The most obvious example of a cybercrime is hacking. Hacking involves the illegal access of a computer without the consent of the owner. In other words, it’s trespassing with a computer. Is it charged with the same level of severity as trespassing? No, it is not. In fact, many so-called “cybercrimes” have exaggerated penalties based simply on how they were perpetrated. In addition, since the term “cybercrime” is defined so vaguely, prosecutors have a tendency to throw the proverbial book at defendants. Then they whittle away the charges for which they have weak or little evidence to bully the defendant into accepting a bad plea. Meanwhile, this plea could result in serious jail time.

Different Kinds of Cybercrimes

There are, essentially, two kinds of cybercrimes: Those against a user and those against property. cybercrimes aimed at users include:

  • Identity theft
  • Solicitation of a minor
  • Possession of child pornography
  • Phishing
  • Online harassment
  • Cyberstalking

Cybercrimes aimed at property include:

  • Hacking
  • Copyright infringement
  • Data theft
  • Credit card fraud

It is important to understand that many of the crimes have mandatory minimum sentences that judges may apply if you plead guilty or are found guilty. Cybercrimes can be charged as third, second, and even first-degree felonies.

Higher charges involve attempts to lure, defraud, or disrupt the operations of government agencies or medical centers.

Defending against Cybercrimes

The question often involves how the prosecution came about its information. The government has wide latitude to execute warrants against those it suspects of executing an attack from a computer. Nonetheless, hackers generally don’t carry out nefarious schemes from their home network. In fact, they use other people’s computers to carry out these schemes. Furthermore, they can harness the computing power of legions of computers without their users even being aware of it.

Sometimes, genuinely innocent people are charged with crimes that they did not commit simply because their computer has been hijacked.
