What is Counterfeiting Currency?

Counterfeiting currency is a crime under state and federal law. In Florida, counterfeiting currency is defined as the possession or creation of false money, knowing that it is false or counterfeit, and having the intent to pass it off as real currency. The same applies to the possession or creation of currency bills and the possession of any tools needed to create counterfeit bills. State cases of counterfeiting currency are usually investigated by local and state law enforcement officials.

Counterfeit currency is prosecuted on the federal level by the IRS, FBI, DEA, Secret Service, and the Department of Justice. Under federal law, the crime of counterfeit currency is defined as anyone who has the intent to defraud through the creation or possession of fake U.S. currency with a bill that looks similar enough to an authentic piece of currency it would confuse an ordinary, unsuspecting person. The federal government also pursues serious charges against anyone who possesses the equipment to counterfeit currency, as well.

Punishment for Counterfeiting Conviction

In Florida, the punishment for counterfeiting currency is a third degree felony conviction. A third degree felony is punishable with up to five years in state prison, five years of probation, and a $5,000 fine. Under federal law, a person convicted with counterfeit currency can also face a federal prison sentence of up to twenty years in addition to a fine up to $250,000. If caught with the equipment needed to create counterfeit currency, the federal punishment is a Class B felony, which comes with a federal prison sentence of up to 25 years and a fine up to $250,000. The severe punishment that comes with counterfeiting currency is why you need an experienced criminal defense attorney by your side from the moment you suspect that you are being investigated for this crime.

How a Criminal Defense Attorney Can Help

A criminal defense attorney can help you at every step of the investigation and trial process if you are suspected of counterfeiting currency. Oftentimes, federal authorities will bring a suspect in before they are charged to conduct interviews and gather evidence. Having an attorney present can protect your rights and ensure no statement is made against your best interest.

If charged with counterfeit currency, a criminal defense lawyer will be there with you through every step of arraignment, bail hearings, and trial. They will interview witnesses, gather evidence, and prepare your case for court. Federal criminal proceedings are different than those at the state level, so it is important that you have a criminal defense attorney that has experience with both.
