The Florida judicial system’s sentencing guidelines for the sale of illegal or prescription drug convictions can include:

  • Marijuana sale: Third-degree felony, up to five years in prison
  • Marijuana sale within 1,000 feet of a school or church: Second-degree felony, up to 15 years in prison and a $10,000 fine 
  • Cocaine sale: Second-degree felony, up to 15 years in state prison
  • Cocaine sale within 1,000 feet of a church or school: First-degree felony, mandatory minimum of three years in prison
